“Laws are like sausages, it is better not to see them being made”, said Bismark. And he was right, but only after a fashion. It is now no longer possible to observe our laws being made and the process has got to the stage where it is beyond human comprehension.
Take, for instance, the classification, packaging and labelling of dangerous substances.

Although these issues are currently controlled by EU law, specifically Regulation (EC) No 1272/2008, there is much more to the law than meets the eye.

For a start, one should note that UK was actually one of the first in the field, as this website helpfully shows: we go back to the Petroleum Act of 1879 and the Petroleum (Consolidation Act) of 1928. The latter remained (with subsidiary regulations) the major legislative control on the transport of all dangerous substances until the 1980s.

By then, EU had got into its stride and the issue had long been an EU “competence”. The original laws from that source was Council Directive 67/548/EEC, which was modified several times up to and including Commission Directive 86/431/EEC.

In 1978, however, there had been an appalling tanker disaster in Alcanar, near Tarragona, in Spain. A tanker truck loaded with 23 tons of highly flammable liquefied propylene had blown up, killing 217 people (including the driver). Some 200 more had been severely burned.

This triggered a period of legislative hyperactivity and by the early ’90s, there had been so many amendments that some tidying up was badly needed. The European Commission thus proposed consolidating law in 1993, and again in 1994, but the proposal was withdrawn on 9 January 2004 when it had become obsolete.

The reason for this is that global governance had taken over.

In 1992 the lawmaking responsibility had been transferred to the United Nations Conference on Environment and Development (UNCED). It was coordinated and managed under the auspices of the Inter-Organisation Programme for the Sound Management of Chemicals (IOMC) Coordinating Group for the Harmonisation of Chemical Classification Systems (CG/HCCS).

Just to make it interesting, the participating organisations of IOMC were the Food and Agriculture Organization of the United Nations (FAO), the International Labour Organization (ILO), the Organisation for Economic Co-operation and Development (OECD), the United Nations Environmental Programme (UNEP), the United Nations Industrial Development Organization (UNIDO), the United Nations Institute for Training and Research (UNITAR) and the World Health Organization (WHO).

However, once work got underway, The Global Environment Facility, the United Nations Development Programme (UNDP) and the World Bank joined the IOMC participating organisations. The joined with the International Forum on Chemical Safety (IFCS) in a steering committee established to oversee what became known as the Strategic Approach to International Chemical Management (SAICM).

To ensure this process ran on track, the technical focal points for completing the work were handed to the ILO, the OECD and the United Nations Economic Social Council’s Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCETDG). Once completed in 2001, the work was transmitted by the IOMC to the new United Nations Economic and Social Council’s Sub-Committee of Experts on the Globally Harmonised System of Classification and Labelling of Chemicals (UNSCEG/GHS).

UNEP and WHO took lead roles in the secretariat in their respective areas of expertise and the Transport Division of the UNECE provided secretariat services.

With their assistance, the first version of a Globally Harmonised System (GHS) was approved by the Committee of Experts in December 2002 and published in 2003. It was this, plus revised editions published in 2005 and 3007, which is more or less the definitive version of the law.
This, as we all know, forms the basis of Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008. And, being a European Regulation, it takes direct effect, automatically passing into British law. It doesn’t even need the agreement of the Westminster Parliament.

Once we leave the EU, though, we can scrap this horrid EU law, wave goodbye to the New World Order and dust off the Petroleum Act of 1879 and the Petroleum (Consolidation Act) of 1928. Then, we can go back to Scammell tankers, Morris Marina vans and corner shops. All will be well with the world.

Interestingly this Law, Edict, Convention, Agreement or what ever you wish to call it is thus a new version of Britain’s 1879 Petroleum Act as amended  as a Consolidation Act of 1928 as nacted by global agreement and signed into law by The Uruguayan Housing Minister and The Swedish Environment Minister on behalf of its global assentors! All this without so much as a murmur of British input to the new version and given the visible imprimatur, meaningless as it may be, of The EU!

It does rather put in perspective the naive and crassly irresponsible claims of Farage’s Party and his delusional fan club in the UKIP cult when they simplistically claim that Article #50 is a trap and that all Britain needs to do is pass some half baked three line paving act and send a bus to Brussels to collect our staff!

The staggering misunderstanding of their sometime economics spokesman Prof Tim Congdon is astonishing!

Granted he is an economic theorist and since economics is not a science but a mish mash of theories it is maybe not so surprising that he has so little understanding of the realities of international treaties as displayed in his writings and publications.

I happily concede I tend to read his papers and also his think tank web site not infrequently but I find it seems more to sell his viewpoint than to solve the problems of our nation or offer solutions for UKIP.

Let us not forget Congdon did try to gain the leadership of UKIP at one stage but seemed to be being sabotaged by his so called agent!

It would be interesting to watch the squirmings of both Farage and his clique and Tim Congdon as thery tried to address the outline of the enactment of law on a global basis! To date they have never come anywhere close to having a strategy for exit from the EU and the complexity of surviving the withdrawal.

Do not forget that UKIP has failed totally to address policies on a grown up basis endlessly coming up with half thought out policies where cutting their losses they never seem to competently cost their plans nor address the issues with any degree of gravitas tending to take the childish and irresponsible course of populism.

Fear is always a popular tool in the hands of the self obsessed and ambitious!

BREXIT Shows That At Least Someone Is Thinking!

Hi,

for almost 25 years I have been seeking out some organisation of repute that has, or is devising, an EU Exit & Survival Strategy.

For the best part of that time I had hoped that UKIP m,ight act responsibly and draw up the details of such a plan and the strategic points and tactical steps required but sadly despite some 15 years of highlighting their structural inadequacies, leadership ineptitude and profound lack of gravitas or intellectual rigour they have failed on all counts to both represent the best interests of the Leave-The-EU movement they CLAIM to represent and have been followers rather than leaderrs!

To this day UKIP has manifestly displayed a lack of strate gic planning, an absence of tactical plans and absolutely no signs or any kind of an Exit & Survival Strategy and no evidence of making any steps towards such a policy/plan - being reliant rather on opportunistic self interest abjectly failing to educate the public on the issues or for that matter themselves and their members and supporters!

At last someone is thinking:.

A referendum has resulted in an “Out” vote and Her Majesty’s Government has triggered Article 50 of the Lisbon Treaty. What measures does the UK need to take in the following two years, domestically (within the UK), vis-a-vis the remaining EU and internationally, in order to promote a free and prosperous economy?
Background
An “Out” vote in a British referendum would be a major historic geo-political and economic event, perhaps even comparable with the fall of the Berlin Wall and the subsequent collapse of the Soviet Union and re-unification of Germany. It is time, therefore, that the UK explores the process of withdrawal and its economic and political consequences. This competition is designed to examine the process of withdrawal and, more importantly, how the UK might fit into the fresh geo-political and economic landscape that would follow.
Entry Requirements
Against this background, competitors are invited to compose a Blueprint for Britain outside the EU, covering the process of withdrawal from the EU and the post-exit repositioning of the UK in the global trading and governance systems, covering, inter alia:
  • The legal and constitutional process necessary for the UK to leave the EU and set up, if desired, alternative international relationships. This would include not just the process within the EU itself but the changes to UK law and regulation that would be desirable or necessary.
  • Negotiation of the UK’s post-EU-exit position to settle the UK’s relationships with the remaining EU and other interested parties and, crucially, with the rest of the world, in respect of trade, supranational governance, immigration, the environment, financial regulation, defence etc.
Submissions are invited from individuals, groups of individuals, academia and corporate bodies such as consultancy firms, law firms, accounting firms, think-tanks and investment banks. Initial submissions will be around 2,000 words. The competition’s initial judging panel will then invite the authors of around twenty of those entries to make full submissions of between 10,000 and 20,000 words within a further four months.

Prizes
Cash prizes will be awarded to the first, second and third best entries, as judged by the competition’s final judging panel. Hi,

it is interesting to note the number of informed individuals who now realise that UKIP under its present corrupt and inept leadership team are not fit for purpose and as utilisers of various forms of attempts at cyber bullying and dishonesty to secure their income stream on the EU gravy train are clearly more dangerous in many ways than the self destructive EU they feed on!

Let us not forget that Eric Edmond was elected to UKIP NEC by the members and bullied off when he scared the leadership by seeking transparency and accountability!

It is interesting to note that he too has become aware of just what a problem to EUroScepticism UKIP's self enriching and self serving leadership are as shown by his posting below:

Prober outlines EUKIP's failings

There is someone who posts on Butcher's forum under the nom de plume Prober who is one of the few worth reading on that site. Most of the posts are made by anonymous Farage wannabee MEPs eg Gothmog  who are scared to post under their real names and are impervious to huge volumes of inconvenient facts. Click on link to read Prober's latest effort. Its on a thread started by Niall Warry on the topic "What should our Exit and Survival Strategy be from the EU?"

Niall Warry has correctly identified this as a major defect in EUKIP's  largely non-exisitent political strategy. The lack of any coherent strategy is a result of EUKIP degenerating into a Farage cult with talented members being smeared and removed to join the swelling army of former UKIP members which now far outnumbers UKIP members.


I quote Prober's post in full below:
"Clegg says (unchallenged) that UK has to stay subordinate to EU because 2 million jobs and 40% of our exports ( implying 40% of our income) is bound up with EU and would be lost if we pulled out.


One would have thought that ages ago UKIP would have articulated and quantified on its website a vision for a future of and step by step pathway to a UK outside the EU emerging as a global 
outward looking production and bilateral international trading link nation ....to replace the inward looking future of being hampered by a declining high cost EU. An essential part of such public
education would be to identify and realistically quantify the short and long term political and economic costs and and benefits and what would need to be done to ensure that the man in the street is not hit in the pocket and how he would benefit.


In addition, the idea that after (if) UK walks away or renegotiates membership, the EU (despite its problems) is just going to disappear makes UKIP look head in sand ridiculous. To establish its credibility UKIP should have on its website its identification of what a future EU could be like ( an association of free nations in co-operation and negotiated bilateral free trade with no powers over nations) , how it could be structured , how a pathway could come about and what savings would result and what UK's relationship to it would be. UKIP was wedded to election campaignprinciples of "keep it simple just say " NO !" That gets 16% of the vote .


Note that if a referendum on pull out from the EU is held today it would be lost because the "fear factor" would overcome antipathy towards the EU. One would have thought that a prime objective of UKIP would be public education targeted to overcome that fear. Its shop window ( its website) doesnt seem to indicate it is very important.


A party hungry for success would deeply attack the record of big 3 MPS and failure of their parties as cant or wont provide the EU solution in the interests of UK people. UKIP hardly tries except for the odd squeak and MPs can ignore UKIP with impunity. UKIP as a party seems to be an invisible except on displacement activity ( English parliament , MEPs in Pan European party or not, pub campaign) , ... almost an irelevant spectator of events going more or less its way . Despite once having more MEPs than Labour BBC dont invite UKIP on newsnight when economists and EU officials are deliberating EU solutions/problems or the domestic economy is the subject. That fits the concept of a party happy for events to take their course and relieved to disband and support Tories (a la Pearson ) if a referendum is achieved and UK pulls out of the EU. It doesnt fit the concept of a party that has a domestic credibility long term vision."
The problem is EUKIP's laziness. They don't do the research and homework required to rebut and expose LibLabCon lies. Their back up research where it exists is poor quality. Not surprising as the researchers are appointed because of their unquestioning support for Farage and desire for MEP slots rather than talent and ability. This is  mirrored in the poor quality and lack of effort of many of their MEPs like William Legge, Bloom, Nuttall etc. They just want to pose and preen before the diminishing EUKIP faithful and like Farage hope for invites on to Newsnight etc. The problem is they are empty barrels and have nothing worthwhile to say so the invites have dried up. They are not interested in the hard graft and grind of politics like setting up a decent web site, keeping it up to date with relevant facts and authoritative opinion.


Are the Hamiltons, the face of Tory sleaze in the 90s, the people to change this? I don't think so but mores the pity obviously some UKIP members do. 


I compare them with John Redwood who sends out his email every day to anyone interested. Its well researched, well written and commands respect. Redwood is of course a very able man backed up by able researchers.


Farage and his cabal lack depth of knowledge and ability. They are being exposed as shallow and inconsequential compared to Alex Salmond and his able team. EUKIP has to change and Farage and his cabal have to be got rid of or our leave the EU cause is dead.

THE average family would be much better off if we left the EU, according to a leading economist.

Professor Patrick Minford said living standards would rise as Britain enjoyed freedom from the "haven of regulation and state intervention" in Brussels. He suggested the UK will probably "detach itself to a large extent" from the EU over the coming decade.

But leaving altogether could mean cheaper food, clothing and other goods thanks to competition.

An economist at Cardiff Business School, Prof Minford said: "What the EU does is raise the prices of most things traded within Europe through protection given to its single market by trade arrangements.

"Cars, computers, clothes, machinery, food - all have their prices held up by the restrictions on imports from cheaper sources, often China, but also India, New Zealand and South Korea.

"Outside the EU the prices of what we buy would be the cheapest available in the world - our industries would sell their output on their capacity to meet world competition. We would all benefit from buying freely in the world market at world prices. Our living standards would rise."

A member of Conservative Way Forward and the European Reform Forum, he made his comments in the Julian Hodge Institute of Applied Macroeconomics quarterly review.

Critics argued it would be impossible to leave the EU without causing damage.

Labour peer Baroness Eluned Morgan of Ely said: "It is nonsense, because there is no doubt that we would lose jobs. Our relationship to the EU is fundamental to our economy."

Critics may well claim that 'it would be impossible to leave the EU without causing damag' however no critic has EVER supported their defeatist fantasy with substantive facts nor cogent argument being it seems utterly dependent on largely dishonest spin.

You will note that Elunid Morgan whose only real job was as a researcher for the subsidised BBC and within its extremist and hugely subsidised S4C - a job she can not have held for more tyhan a few minutes assuming she graduated from Hull University! She moved into full time politics working for the EU at age 23 - little wonder she peddles their dishonest propaganda for her EU pension entitlement and it is to promote The EU she is rewarded with a Baronecy yet fails to declare her interests as she further betrays these United Kingdoms and Wales in particular in The House of Lords (phoney cronies!).

It would serve the media well to list financial interests of tyhose they quote!

Perhaps Mrs. Morgan would care to back her claim with informed validation as even The Labour Government showed through the independent survey they conducted via the largely left wing think tank that there were NO jobs overall that were dependent on membership of the EU outside of political (parasitic) jobs and as confirmed by the ex Labour leader and ex EU commissioner Niel Kinnock - 'there would be no loss of jobs and The EU would NOT penalise Britain and block trade' - he is of course correct though under stated as Labour's report showed a likeluihood of a net gain in jobs and that it would not be in the interest of The EU to block trade nor would it be legal under WTO rulings.

Interestingly the new liberty would provide huge scope for growth and freed of the obligation to pay the EU £50 million a day not only could the money be used to modernise Britain's infrastructure and invest in growth.

Free of the malign strictures of The EU we could tarriff transit trade and lift many of the petty restrictions on business designed to counter Britain's interests relative to those of failed Mediteranean countries.

Britain would also be freed of the EU tendering scams that have so damaged our industries such as automotive, aerospace, nuclear power, power generation, fishing and the like and the crass break up of Royal Mail to suit EU rules and the idiocy of imposition of the hugely costly and largely irrelevant HS2 which will prove so damaging to the Midlands and the countryside on route as they commute and take jobs to London.

It is hard to think of a single benefit of EU membership yet so easy to note how much damage membership has done to these United Kingdoms - One should also be aware of the gathering dislike of those in The EU who consistently seek to impose their needs and greeds on Britain, and it can be argued that the EU is increasingly being fermented as a cauldron of hatred managed by unelected bureaucrats for their personal gain as no fool would see The EU as of benefit beyond grubby self interest of a small clique and the4ir claque milking the 500,000,000 serfs in the vassal states in an obscene manner.

EXIT AND SURVIVAL STRATEGY – FIRST PRINCIPLES

1. We need to renegotiate our position over a number of years and not simply leave -Time scale for renegotiation could be say 5 years for the key principles and possibly 10 before our new renegotiated position is fully implemented and operational.

2. Payments to the EU budget would be reduced over say 5 years

3. Taking part in Euro elections along the way of our renegotiation need to be considered with the following types of considerations that the terms and conditions of all existing MEPs are in the main the responsibility the EU and any new MEPs, if applicable, being paid but not pensioned by the EU.

4. Withdrawal from the CAP and CFP and negotiating a free trade agreement would be 3 of the key areas to sort out within the first 5 years.

5. Parallel trade negotiations would need to start from day one with Commonwealth and any other countries we trade with.

6. 10 year plan to resort our own judicial system

7. Border immigration controls could be one of the few areas to take back control of on day one while the negotiations to repatriate, absorb or redefine visa status for EU citizens in this country would take longer.

8. Unwinding the tentacles of our defence that are tied up with the EU would take 5-10 years but the aim would be our own defence force capable of operating on its own to accomplish all the tasks required of it by the Country’s defence responsibilities.

9. Sole UK Foreign policy reinstated over a first few years

10. The repeal of EU bureaucracy in trade, industry, H&S, NHS or education etc etc phased over first 5 years

So the list can go on. This business of our E&SS is no easy matter but where are the people giving this thought and why is UKIP not leading on this?

Sorry I forgot EUKIP MEPs are far too busy getting p***ed in Brussels................. I wonder when Nigel last held a strategy and tactics meeting with his MEPs?
